Comments on HB 1674

This proposed "Employee Restroom and Locker Room Access Act" may purport to address concerns about restroom access, but its restrictive provisions are nothing short of draconian, particularly in their impact on transgender individuals. By rigidly defining gender identity and limiting restroom use based on outdated notions of biological sex, this bill not only perpetuates harmful stereotypes but also creates a hostile environment for transgender employees. The Act's narrow exceptions for individuals who have undergone a full medical procedure to change their sex are both invasive and discriminatory, disregarding the dignity and autonomy of transgender individuals who may not pursue such procedures or for whom it may not be medically advisable. Furthermore, singling out transgender employees in this manner only serves to stigmatize and marginalize them within the workplace. By restricting restroom access based on sex, the bill undermines the very essence of human rights and equality. Transgender individuals deserve to be treated with respect and afforded the same rights as their cisgender counterparts. This legislation not only fails to protect the rights of transgender employees but actively endorses discrimination, contradicting the principles of inclusivity and equal treatment that should be the foundation of any just society.

This capsizes the mission of the Commission on Human Rights and weaponizes the Commission against citizens of our state. It is immoral and unethical to discriminate and harm people. The bill fails to take into account variations in the human condition.
